European Court of Justice sets milestone in 3D trademark validity in Vespa dispute

On 29 November 2023 the European Court of Justice (ECJ) issued a pivotal decision to overturn the ruling of the Fifth Board of Appeal of the EUIPO. This significant turn of events centred around the 3D trademark of Italian company Piaggio’s Vespa scooter. The EUIPO had initially concurred with the Chinese firms, concluding that Piaggio’s 3D European trademark that protects the iconic Vespa scooter’s shape was invalidly registered. The court recognised the 3D European trademark as valid and as having achieved distinctiveness throughout the European Union due to its documented usage by Piaggio. The court’s decision marks a significant milestone in recognising the validity of 3D trademarks that have attained distinctive capacity, particularly in cases involving iconic design products like Piaggio's Vespa.

3D Trademarks the Vespa scooter case

The dispute commenced in the ambit of an international fair where Piaggio enforced two three-dimensional trademarks; they are one Italian three-dimensional trademark and a Community three-dimensional trademark, both protecting the Vespa shape, exclusively the Vespa shape, because they are three-dimensional trademarks. Moreover, and this argument was absolutely important for the case together with the 3D mark, Piaggio sustained and proved that this was a case also of copyright infringement because Vespa was protected by copyright. It’s clear that, when Corradino D’Ascanio in 1945 created the Vespa, his intention was to put into the Italian market a motorcycle. The trademark, as you can see, corresponds to the Italian trademark registration that we have seen before. It is protected as a three-dimensional trademark and it’s coming in enjoying protection for registered design and also of industrial design protected under copyright.
